The seller and/or the buyer can now ask for the balance of the sale paid at act, is deposited with the notary until the act is transcribed. An act should be transcribed within 30 days – but this is enough time for a lien to be taken on the property in the old owners name. If you have a notary who transcribes the atto in 2 or 3 days it’s an unnecessary step in my opinion, but the notary is obliged to do this if requested by one of the parties. Bear in mind that the seller may be violently opposed to such a measure, and can decide to call off the entire sale if he chooses.
